North Carolina Court of Appeals rules in favor of Attorney Chris Brook’s client in workers’ compensation appeal

The North Carolina Court of Appeals issued a unanimous, published decision in favor of Patterson Harkavy attorneys Chris Brook, Paul Smith, and Hank Patterson’s client.

In Rimmer v. Town of Chapel Hill, the claimant was a career firefighter who was unable to continue working due to severe PTSD developed as a result of his work. The Industrial Commission found that he was not entitled to workers’ compensation benefits because he should have filed his claim earlier in his career.

On appeal, attorneys Chris Brook and Paul Smith secured an opinion reversing the Full Commission’s decision, and finding that the claimant timely provided notice of his condition and timely filed his claim. Click here to view the Court of Appeals’ decision.
