Judge vacates Silent Sam judgment on grounds requested by UNC alumni represented by Patterson Harkavy

Burton Craige and Narendra Ghosh represent 88 prominent UNC alumni who oppose UNC’s payment of $2.5 million to the Sons of Confederate Veterans (SCV) to settle a lawsuit about the disposition of the statue known as Silent Sam. On January 29, Patterson Harkavy filed an amicus brief arguing that the court should not have entered a Consent Judgment because SCV had no standing to bring the lawsuit. Burton spoke at the hearing in Hillsborough yesterday. Click here to read Burton’s remarks.

Judge Allen Baddour then ruled exactly as we requested: he found that SCV had no standing, vacated the Consent Judgment, and dismissed the lawsuit.

The ruling was an important victory for the entire University community and received extensive media coverage, including in on WRAL, the News & Observer, the New York Times, and the Washington Post.
